General Terms and Conditions for Owners

Version: 17 October 2026

These General Terms and Conditions (GTC) govern the use of the GREM platform by private owners who wish to sell or let a property in Germany. The provider is GREM CAPITAL LIMITED, 54 Kestrel Avenue, SE24 0EB London, Vereinigtes Königreich, e-mail: [email protected] (hereinafter “GREM”). Further information on the provider can be found in the Legal Notice.

Terms used in these GTC to designate persons apply to all genders.

§ 1 Scope

(1) These GTC apply to all contracts between GREM and owners concerning the use of GREM for properties in Germany via the website de.grem.capital, the user account in the web browser (hereinafter the “GREM account”) and the GREM apps (together the “Platform”), both for free use and for paid packages (§ 11) and the report audit (§ 12).

(2) An owner within the meaning of these GTC is any person who, as a consumer (§ 13 BGB, German Civil Code), wishes to sell or let a property in Germany and uses the Platform for this purpose. This also includes any person who is entitled to market the property, for example a co-owner with the consent of the other co-owners or an authorised representative of the owner. Prospective buyers and tenants are hereinafter referred to as “prospects”.

(3) The location of the property is decisive: for a property in Germany, these GTC apply irrespective of the country for which the GREM account is maintained.

(4) These GTC apply only to consumers. The General Terms and Conditions for Brokers apply to brokers and brokerage firms.

§ 2 Role of GREM

(1) GREM offers a selection service: the Platform shows the owner verified brokers in the vicinity of their property, and the owner decides for themselves whether to choose a broker and which one. GREM does not select a broker for the owner and does not assign one to them; responsibility for the selection lies with the owner.

(2) GREM is not a broker. GREM is a party neither to the brokerage contract nor to any purchase or lease agreement concerning the property, does not conduct negotiations and does not participate in the conclusion of such contracts.

(3) The brokerage contract is concluded directly between the owner and the broker. The content, form and term of the contract, any exclusivity, and the amount and allocation of the commission are agreed solely by the contracting parties; GREM neither reviews nor regulates these matters. Compliance with the statutory requirements for brokerage contracts (in particular §§ 652 et seq. and §§ 656a et seq. BGB) is the responsibility of the contracting parties.

(4) The owner pays GREM neither a basic fee nor a commission nor a success fee. Costs are incurred by the owner only if they themselves order a paid package (§ 11) or a report audit (§ 12).

(5) GREM finances the Platform primarily through fees paid by brokers. For the transmission of an owner’s contact, the broker who accepts the request pays GREM a fixed amount, which depends on the type of property and, for properties for sale, on the category of the property (§ 5 paragraph 4). GREM does not share in the broker’s remuneration. The terms agreed between the owner and the broker are not affected by this.

(6) GREM does not provide legal, tax or financial advice, nor the services of an expert.

§ 3 Registration and GREM account

(1) Registration is free of charge and requires that the user be of legal age and have unlimited legal capacity. Upon completion of registration, a free-of-charge user agreement is concluded between GREM and the owner.

(2) The owner provides true and complete information during registration and use and keeps it up to date.

(3) During registration, the owner confirms their mobile phone number with a code that they receive by SMS. Without a confirmed number, the owner cannot send a request to a broker. A mobile phone number can be confirmed for one owner account only.

(4) The owner keeps their login credentials secret. The GREM account is not transferable.

§ 4 Free services

(1) The following, in particular, are free of charge:

  • registration and the GREM account;
  • creating properties (apartment, house, plot of land, commercial property);
  • the AI valuation of the property in euros (§ 5);
  • the list of verified brokers in the vicinity with their rating and the selection of a broker (§ 6);
  • publication of the property in the GREM catalogue as soon as the catalogue has been activated (paragraph 3);
  • communication with the chosen broker after the broker has accepted the request.

(2) In Germany, an owner account may publish at most as many properties at the same time as is stated on the Platform (currently three). The owner may create further properties as drafts; they will be published only once a slot becomes free. Only brokers with a plan under the General Terms and Conditions for Brokers may publish more properties at the same time.

(3) The public catalogue and the map will be activated only once a sufficient number of properties is available in the pilot regions. Until then, a property is not publicly visible in the catalogue. No telephone number is displayed in the catalogue; prospects make contact by means of a request on the Platform. For a listing of an owner without a broker, the Platform indicates that the request will be received by the broker chosen by the owner or by the owner themselves.

(4) GREM may change or discontinue free functions where this is reasonable for the owner, for example for technical or legal reasons or for reasons of security. GREM will inform the owner of material restrictions in good time in advance.

§ 5 AI valuation

(1) The AI valuation is an automated estimate of the value of the property based on the information provided by the owner, comparative data and statistical models. It may be output as a single value or as a value range. No inspection takes place.

(2) The AI valuation is not an expert opinion and not a determination of the market value within the meaning of § 194 BauGB (German Federal Building Code). It does not replace an expert’s opinion and is not intended for submission to courts, authorities, tax offices or credit institutions. Where GREM additionally provides a short valuation report, the same applies; the report is labelled accordingly.

(3) The accuracy depends essentially on the information provided by the owner and on the available data. GREM gives no warranty that the estimated value will be achieved on the market.

(4) The AI valuation also determines the category of the property, which determines the amount that a broker pays GREM for the transmission of the contact (§ 2 paragraph 5). If no AI valuation is available, the category is determined on the basis of the price stated by the owner and is labelled “Category based on the owner’s price”. The category is displayed to the owner; it gives rise to no costs for the owner.

§ 6 Selection of a broker

Brokers displayed and order

(1) Only brokers with an account for Germany who have the status “§34c verified” and an active plan appear in the selection list.

(2) The list is sorted by distance from the property, with the nearest brokers first; the distance is displayed. The owner may extend the search radius step by step. If no broker is found even then, GREM informs the owner accordingly, and the owner may choose to be notified as soon as a verified broker becomes available in their vicinity. GREM does not currently offer better placement in this list against payment.

(3) A broker’s card shows in particular the name, photo, company, area of activity, the “§34c verified” badge, the rating R, the number of the broker’s properties in the vicinity, reviews, working languages and the average response time; where there are fewer than three reviews, “New on GREM” is shown instead of R. The broker’s telephone number, e-mail, website and chat become accessible only after the request has been accepted; the broker’s legal notice is available on a separate page of their profile.

(4) The rating R is based in particular on reviews and feedback from owners and prospects as well as on the broker’s response behaviour, for example exceeded response deadlines. Reviews of a broker may be submitted only by owners and prospects whose contact was transmitted to that broker via the Platform. Reviews must be based on the reviewer’s own experience and be objective.

(5) The “§34c verified” badge means that GREM has reviewed, partly by automated means, the licence under § 34c GewO (German Trade Regulation Code) and, in the case of companies, an extract from the commercial register, and that a GREM employee has approved them. The review relates to the documents submitted; it makes no statement about the quality of the broker’s work.

Request and acceptance

(6) The owner chooses a broker and sends them a request. Only one request may be open at any one time. Before the request is sent, GREM obtains consent to the transmission of data (§ 9).

(7) The broker may accept or decline the request within four working hours. Working hours are Mondays to Fridays from 8 h to 20 h and Saturdays from 9 h to 14 h (time zone Europe/Berlin), excluding nationwide public holidays and public holidays applicable throughout the federal state in which the broker has its place of business; if the broker has not specified a federal state, only nationwide public holidays are counted. If the broker declines or the deadline expires, the owner is notified and may choose another broker themselves; there is no automatic forwarding. If the owner does not choose a new broker, GREM reminds them twice at an interval of 48 hours; the request remains stored in the GREM account.

(8) Before acceptance, the owner’s contact details are not visible to the broker. Upon acceptance, the broker receives the owner’s contact details and the information on the property and may take over the property as their own listing. The owner’s listing is removed as soon as the broker publishes their version.

(9) The owner may hand over materials from booked packages to the chosen broker using a function of the Platform; upon acceptance, they pass to the broker together with the property. For the rights of use, see § 10.

Contact and assignment for up to 14 days

(10) The broker must contact the owner within three days via GREM’s telephony or chat. Mondays to Saturdays are counted, excluding public holidays within the meaning of paragraph 7; the day of acceptance is the first day, and if acceptance takes place after 18 h, the period begins on the following day. If the broker does not make contact via GREM within this period, the owner is released and may choose another broker.

(11) After acceptance, the owner will not be transmitted to any other broker via the Platform for up to 14 calendar days from acceptance, as long as the owner does not end the cooperation; the three days under paragraph 10 are included in this period. The owner may end the cooperation at any time in the status of their request by selecting “Broker was not a good fit”; the owner is then released immediately. The owner’s feedback is taken into account in the broker’s rating. If the cooperation ends in this way or under paragraph 10, any version of the property taken over by the broker is paused. If the owner does not answer the broker’s calls, this does not end the assignment.

(12) After the 14 days have expired, the owner may additionally choose a further broker; if several brokers are working on the same property, it is displayed as one card showing all brokers. The assignment under paragraph 11 concerns only transmission via the Platform; it does not affect the brokerage contract or decisions taken by the owner outside the Platform.

(13) Telephone calls via GREM’s telephony are not recorded. The time and status of calls and messages are stored.

§ 7 Prospects and direct cooperation

Requests concerning the property

(1) Prospects make contact by means of a request on the Platform. In doing so, they consent to their data being transmitted to the owner or to the broker chosen by the owner. Prospects introduced by another broker, including one from abroad (hereinafter “partner broker”), additionally confirm their consent via a link; their data are not transmitted before then.

(2) If a broker has accepted the owner’s request, that broker receives the requests from prospects concerning the property. If the owner’s request is still awaiting a broker’s response, the prospect’s request waits as well and goes to the broker who accepts the owner’s request.

Direct cooperation

(3) If the owner has booked a package that includes direct cooperation (§ 11 paragraph 1), the owner may work with prospects directly via GREM’s system (telephony and chat). With a prospect introduced by a partner broker, cooperation takes place via that partner broker; the partner broker’s name is displayed to the owner as soon as the assignment is established. The owner receives the contact details of prospects within the framework of this direct cooperation.

(4) In direct cooperation, the owner conducts conversations, viewings and negotiations personally and on their own responsibility. GREM does not take part in them and does not owe the conclusion of any contract. GREM verifies information provided by prospects only where this is expressly stated on the Platform, for example by means of a verification badge. A contract for the purchase of a plot of land or a condominium requires notarial certification (§ 311b BGB).

(5) Use of the Platform does not give rise to any obligation on the part of the owner to pay remuneration to a broker or partner broker. Such an obligation can arise only from a separate agreement with that broker.

(6) Note: The buyer may come from abroad. If you do not speak the buyer’s language, we recommend that you choose a broker. The languages in which a broker works are stated on the broker’s card.

Owners without a broker and without a package

(7) If the owner has neither sent a request to a broker nor booked a package and a prospect makes a request, GREM informs the owner that there is a prospect for their property. The owner may choose whether to work with the prospect themselves (booking a package with direct cooperation) or to choose a broker who takes over the marketing. The owner has 24 hours to make this decision.

(8) If the owner does not decide within this period or declines, the prospect is released, and the owner receives a message to that effect. The owner may choose resumption once per property. The owner then has 48 hours to actually take action: either send a request to a chosen broker or pay for a package and upload at least five photos of the property. Payment alone is not sufficient. If this does not happen, the prospect is finally released.

(9) Sundays, nationwide public holidays and public holidays applicable throughout the federal state in which the property is located are not counted for the periods under paragraphs 7 and 8. The prospect and any partner broker introducing them can see by when the owner will decide (“Owner will decide by …”) and may withdraw their request at any time.

(10) There is no entitlement to a prospect waiting or to a transaction being concluded. GREM does not sell contacts of prospects; the price of a package is owed for the services described therein.

§ 8 Obligations of the owner, content and moderation

(1) The owner lists only properties that belong to them or that they are entitled to market and that they actually wish to sell or let. The owner’s information on the property must be true, complete and up to date.

(2) The owner is responsible for the information on the energy performance certificate. The Platform requires one of three statements: energy performance certificate available; not yet available (in which case the listing shows “Energy performance certificate will be presented at the viewing”); listed building with no obligation to provide an energy performance certificate (only where heritage protection has been confirmed). The obligations of the seller or landlord under the Building Energy Act (Gebäudeenergiegesetz), for example presenting the energy performance certificate at the viewing, remain with the owner.

(3) In particular, content that violates laws or the rights of third parties, that is misleading or that discriminates, for example contrary to the General Equal Treatment Act in connection with letting, as well as advertising for third parties and unsolicited mass messages, is prohibited.

(4) The owner checks texts, translations, images and videos that the Platform creates or edits wholly or partly with the aid of AI for accuracy before using them. Virtually staged representations or representations otherwise altered with AI must not be passed off as unaltered images of the property; the owner points out the alteration where the representation could otherwise create a false impression of the condition of the property.

(5) Brokers may submit a complaint about an owner via the Platform, for example because the owner is not the owner or is not entitled to market the property, because the property does not exist or because the owner does not wish to sell. If such complaints are received from brokers of two different companies, the owner’s account is blocked and GREM investigates the matter. GREM informs the owner of the block and the reasons for it and gives the owner the opportunity to comment; if the complaints prove unfounded, GREM lifts the block. A single complaint does not lead to a block but is recorded.

(6) GREM may check content and accounts for compliance with these GTC and the law, partly by automated means and also with the aid of AI; doubtful cases are reviewed by employees. In the event of violations, GREM may block or remove content, restrict its visibility or block the account wholly or partly, choosing the least intrusive suitable measure.

(7) GREM informs the owner of measures under paragraphs 5 and 6, stating reasons (Art. 17 of Regulation (EU) 2022/2065, Digital Services Act). The owner may object at [email protected]; GREM reviews the objection and communicates the result. Recourse to the courts remains unaffected. Anyone may send notices of illegal content to [email protected], precisely identifying the content and stating reasons.

§ 9 Consents and data protection

(1) The owner does not give consent to the transmission of their data upon registration but each time a request is sent. By choosing a broker, the owner consents to their data and their property being transmitted to the broker chosen by them. When uploading photos, the owner makes the declaration under § 10 paragraphs 3 and 4.

(2) For each consent, GREM stores the version of the text, the date, time, language and IP address. The owner may withdraw a consent at any time with effect for the future, for example by cancelling or withdrawing the request in the GREM account or by writing to [email protected]. Data that have already been transmitted to a broker are processed by that broker on its own responsibility; the owner asserts rights against the broker directly with the broker.

(3) GREM records the course of the owner’s requests (for example choice of broker, acceptance, contact, time and status of calls and messages via the Platform) in an event log and retains it for five years in order to be able to prove deadlines and processes to the parties involved.

(4) GREM informs the owner of events relating to their properties and requests in the GREM account and by e-mail, push notification or SMS.

(5) Details of the processing of personal data, including the use of AI services and retention periods, are set out in the Privacy Policy.

§ 10 Photos and other content: rights of use

(1) The rights to photos, panoramas, floor plans, texts and other content uploaded by the owner (hereinafter “Content”) remain with the owner or the respective rights holder.

(2) The owner grants GREM a non-exclusive, royalty-free right of use in their Content, unrestricted as to territory, to the extent necessary for the services of the Platform: to store the Content, to reproduce it and make it publicly available in the GREM account, in the listing, in the catalogue and on a landing page for the property, to adapt it technically (for example format and size), to edit it for booked packages (for example by retouching, virtual staging or the creation of a floor plan, exposé, video and 3D tour) and to transmit it to the broker chosen by the owner. The right of use ends upon deletion of the Content, the property or the account; statutory retention obligations, storage in accordance with the Privacy Policy (for example in backups) and Content already handed over to a broker (paragraph 3) remain unaffected.

(3) Upon transmission to the chosen broker, the owner grants that broker a non-exclusive right of use in their Content and in the materials from booked packages for the purpose of marketing this property, including on real estate portals. The owner and the broker may agree on the duration and further details in the brokerage contract. In the absence of such an agreement, the right of use ends when the broker ceases to market this property.

(4) When uploading, the owner warrants that

  • they created the Content themselves or acquired the necessary rights from the rights holder (for example a photographer), including the right to have the Content edited and to grant GREM and the chosen broker rights of use under paragraphs 2 and 3;
  • persons depicted are not recognisable or have consented to publication;
  • the Content does not infringe any rights of third parties.

This warranty does not give rise to any liability irrespective of fault; the owner is liable for violations in accordance with the statutory provisions.

(5) If the owner culpably infringes the rights of third parties through their Content, the owner indemnifies GREM against the claims asserted by third parties against GREM on that account, including the costs of an appropriate legal defence in the amount of the statutory fees. This does not apply if the owner is not responsible for the infringement. GREM informs the owner without undue delay, gives the owner the opportunity to comment and does not acknowledge claims without consulting the owner. Any contributory fault on the part of GREM is taken into account (§ 254 BGB).

(6) GREM grants the owner a non-exclusive right of use, unlimited in time, in the materials that GREM creates within the framework of a package (for example edited photos, exposé, videos, 3D tour, landing page, texts and translations), to the extent that rights exist in them, for the purpose of marketing the property. This includes the right to hand over the materials to the chosen broker and to grant the broker a right of use under paragraph 3. Rights in the software, in templates and in GREM’s marks remain with GREM.

(7) Photos, videos and the 3D tour from packages bear no GREM mark. The PDF exposé contains the note “created with GREM” in the footer; the property landing page on a GREM subdomain bears the GREM logo. This also applies after the materials have been handed over to a broker.

§ 11 Paid packages

Services

(1) For a property that they wish to sell, the owner may voluntarily book a paid package. The services under § 4 remain free of charge. The following are currently offered:

  • Package for €290: advertising materials for the property, namely editing and retouching of the photos, virtual staging, floor plan, sales-promoting property description with translations, PDF exposé, a short video in portrait format of up to 30 seconds and a landing page for the property; in addition, the possibility of working directly with prospects via GREM (§ 7 paragraphs 3 to 5).
  • Premium package for €490: all services of the package for €290 plus a 3D tour of the property, a detailed video of 60 to 90 seconds and a video presentation with an AI avatar.
  • Upgrade to the premium package: Anyone who has booked the package for €290 may upgrade to the premium package upon payment of the difference of €200.

(2) The package description at the time of ordering is decisive for the scope of services. It states in particular the requirements for the photos, the expected processing time, one free revision and how long the landing page remains accessible. For the 3D tour, GREM requires spherical panoramas, which the owner takes with the GREM app following the instructions or uploads as finished 360° panoramas. The materials are created wholly or partly by automated means, including with the aid of AI.

(3) GREM owes the services described, but not success in selling or a particular number of prospects or requests. Prominent placement of the property in the catalogue is currently not part of the packages.

(4) As long as the owner does not provide content required for a package (for example photos or panoramas), GREM cannot create the materials concerned; GREM informs the owner of this.

(5) The statutory rights in respect of defects apply. The free revision under the package description applies in addition and does not restrict the statutory rights.

Prices and payment

(6) All prices are final prices including 19 % VAT. The price displayed at the time of ordering is decisive. Packages are paid for once; no subscription arises, and nothing is renewed automatically.

(7) Payment is made by payment card, Apple Pay or Google Pay via the payment service provider Stripe. The price is due upon ordering. The owner receives an invoice showing VAT separately as a PDF file.

Ordering and conclusion of the contract

(8) The ordering process is as follows:

  1. The owner selects a package for a property and sees an overview of the services and the final price.
  2. Until the order is submitted, the owner may check and correct their entries or cancel the process.
  3. The owner makes the declaration on the early commencement of performance (§ 14 paragraph 3); an order is not possible without it.
  4. By clicking the button “Order with obligation to pay”, the owner submits a binding offer and initiates payment.
  5. The contract is concluded as soon as payment is successful; GREM confirms this without undue delay by e-mail. If payment fails, no contract is concluded.

(9) The owner receives the confirmation by e-mail before GREM begins performance. It contains the terms of the package, the withdrawal instructions, the wording of the declaration on early commencement with the date and time, and the invoice. GREM stores the order data; the confirmation by e-mail is decisive for the owner. The owner may access, save and print these GTC on the Platform at any time.

§ 12 Report audit

(1) The owner may upload a report on the value of a property prepared by another valuer or expert. GREM reviews this report and communicates a review result on it in text form (report audit).

(2) The report audit currently costs €100 per report (final price including 19 % VAT); the price displayed at the time of ordering is decisive. Ordering, payment and conclusion of the contract are governed by § 11 paragraphs 6 to 9, and the right of withdrawal by § 14. The expected processing time is displayed before the order is placed.

(3) GREM’s review result is not an expert opinion. It is neither an independent valuation nor a determination of the market value within the meaning of § 194 BauGB and does not replace an expert’s opinion; GREM does not prepare reports on the value of properties. GREM does not inspect the property; the review result is based solely on the uploaded report and GREM’s data. It is not intended for submission to courts, authorities, tax offices or credit institutions.

(4) The owner warrants that they are entitled to make the report available to GREM for the purpose of the review, for example because they commissioned it themselves. Copyrights and other rights in the report remain unaffected. GREM uses the report only for the review and for the evaluation under paragraph 6.

(5) The report is read out by automated means, including with the support of AI. This takes place exclusively in the European Union and without storage at the service used for this purpose. The file is deleted 90 days after the review result has been communicated, unless a statutory retention obligation precludes this.

(6) The information on value from the report is incorporated, without personal data, into the data basis of GREM’s AI valuation and continues to be used there even after the file has been deleted. Personal data, such as names, are not incorporated in the process. GREM points out this use when the report is uploaded.

§ 13 Liability

(1) GREM is liable without limitation in cases of intent and gross negligence, for culpable injury to life, body or health, under the Product Liability Act, in the event of fraudulent concealment of a defect and to the extent of any guarantee assumed by GREM.

(2) In cases of simple negligence, GREM is liable only for the breach of a material contractual obligation (cardinal obligation). This is an obligation whose fulfilment is a prerequisite for the proper performance of the contract in the first place and on whose observance the owner may regularly rely. In this case, liability is limited to the damage typical for the contract and foreseeable at the time the contract was concluded. Otherwise, liability for simple negligence is excluded.

(3) The limitations under paragraph 2 also apply to the personal liability of GREM’s legal representatives, employees and vicarious agents. The statutory rights in respect of defects remain unaffected, insofar as they are not directed at damages.

(4) Brokers, prospects and partner brokers are not vicarious agents of GREM. GREM is not responsible for their services, information and conduct. GREM’s own obligations, for example in the review under § 6 paragraph 5 and in the transmission of data, remain unaffected.

(5) Interruptions of the Platform due to maintenance, for reasons of security or due to disruptions beyond GREM’s sphere of influence are possible.

§ 14 Right of withdrawal

(1) If the owner orders a package or a report audit, the owner, as a consumer, has a statutory right of withdrawal of 14 days from the conclusion of the contract. The details and the model withdrawal form are set out in the Withdrawal Instructions.

(2) Withdrawal is effected by an unequivocal statement to GREM CAPITAL LIMITED, 54 Kestrel Avenue, SE24 0EB London, Vereinigtes Königreich, e-mail: [email protected], for example by letter or e-mail; the model withdrawal form may be used but is not obligatory. Timely dispatch is sufficient to meet the deadline.

(3) When ordering, the owner expressly requests that GREM begin performance before the end of the withdrawal period and confirms their knowledge that they lose their right of withdrawal upon complete performance of the contract. The declaration reads: “I expressly request that GREM begin performance before the end of the withdrawal period. I am aware that I lose my right of withdrawal upon complete performance of the contract.”

(4) It follows that:

  • The right of withdrawal expires as soon as GREM has provided the ordered services in full (§ 356 paragraph 4 no. 2 BGB). Until then, the owner may withdraw within the withdrawal period.
  • If the owner withdraws after GREM, at the owner’s request, has begun performance but has not yet completed it, the owner owes compensation for the value of the services provided up to that point (§ 357a paragraph 2 BGB); insofar as GREM has supplied digital content not on a tangible medium, no compensation for value is payable (§ 357a paragraph 3 BGB).
  • GREM refunds payments without undue delay, and at the latest within 14 days of receipt of the withdrawal, using the same means of payment, less any compensation for value owed.

(5) Any statutory right of withdrawal to which the owner is entitled in respect of the free-of-charge user agreement remains unaffected. The owner may, in addition, terminate the user agreement at any time in accordance with § 15.

§ 15 Term, termination and deletion

(1) The user agreement runs for an indefinite period. The owner may terminate it at any time without notice by deleting their account in the settings of the GREM account or the app or by sending GREM a message to [email protected]. The owner may delete individual properties at any time.

(2) GREM may terminate the user agreement by giving four weeks’ notice in text form. The right of both parties to terminate for good cause remains unaffected. Good cause for GREM exists in particular if the owner violates these GTC seriously or repeatedly despite a warning.

(3) If GREM terminates with notice before a paid package or a report audit has been provided in full, GREM provides the outstanding services or refunds the portion of the price attributable to them. If the owner terminates beforehand, the statutory provisions apply.

(4) Before deleting their account, the owner should download any materials they wish to continue using. After deletion, the account and listings are no longer visible to others; how long data are thereafter stored in blocked form and when they are finally deleted is governed by the Privacy Policy. Invoices and payment records are retained in blocked form for the duration of the statutory retention periods. Materials handed over to a broker remain with the broker (§ 10 paragraph 3).

§ 16 Amendments to these GTC

(1) For paid packages and report audits, these GTC apply in the version incorporated at the time of ordering.

(2) GREM notifies the owner in text form of amendments to these GTC for the user agreement at least six weeks before the planned entry into force. The amendments become effective only if the owner expressly agrees to them, for example by confirmation in the GREM account. If the owner does not agree, the previous version continues to apply; GREM may then terminate the user agreement in accordance with § 15 paragraph 2.

(3) GREM changes digital services of a paid package that are provided over a period of time, for example the landing page, only subject to the conditions of § 327r BGB.

§ 17 Complaints and dispute resolution

(1) The owner addresses questions and complaints to [email protected].

(2) GREM is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board within the meaning of the Consumer Dispute Resolution Act (VSBG).

§ 18 Applicable law and final provisions

(1) The law of the Federal Republic of Germany applies. If the owner has their habitual residence in another state, the owner retains the protection afforded by the mandatory provisions of the law of that state (Art. 6 paragraph 2 of Regulation (EC) No 593/2008, Rome I).

(2) The language of the contract is German.

(3) Declarations may be made by e-mail or via the GREM account; text form is sufficient.

(4) If any provision of these GTC is wholly or partly invalid, the remainder of the contract remains valid. The invalid provision is replaced by the statutory provisions (§ 306 BGB).
