Withdrawal Instructions

Scope

These withdrawal instructions apply to consumers who order a paid package for owners or a report audit (review of a valuation report) from GREM CAPITAL LIMITED, the provider of the GREM platform (hereinafter “GREM”, “we” or “us”), via the website de.grem.capital or their GREM account. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed profession (§ 13 BGB, German Civil Code).

The packages for owners comprise in particular the creation of marketing materials for your property, for example the editing and retouching of photos, virtual staging, floor plans, property descriptions and translations, a PDF exposé, videos, a 3D tour and a property landing page, as well as the possibility of contacting prospective buyers and tenants directly via GREM. In a report audit, GREM reviews a valuation report uploaded by you and informs you of the result in text form. The precise scope of services is set out in the description provided when the order is placed. Payment is made once by card, Apple Pay or Google Pay. Details are governed by the General Terms and Conditions for Owners.

Each order is a separate contract with its own withdrawal period. This also applies to an upgrade to a higher package against an additional charge.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which the contract is concluded.

To exercise your right of withdrawal, you must inform us (GREM CAPITAL LIMITED, 54 Kestrel Avenue, SE24 0EB London, Vereinigtes Königreich, e-mail: [email protected]) of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post or an e-mail). You may use the attached model withdrawal form for this purpose, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we receive the communication of your withdrawal from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees as a result of such reimbursement.

If you requested that the services should begin during the withdrawal period, you shall pay us a reasonable amount which corresponds to the proportion of the services already provided up to the point at which you inform us of the exercise of the right of withdrawal with respect to this contract, in comparison with the full scope of the services provided for in the contract.

Premature expiry of the right of withdrawal

In the case of a contract for the provision of services that obliges you to pay a price, your right of withdrawal expires upon complete provision of the service if, before the provision began, you

expressly consented to our beginning the provision of the service before the end of the withdrawal period, and
confirmed your knowledge that your right of withdrawal expires upon complete performance of the contract by us (§ 356 paragraph 4 number 2 BGB).

Your declaration when ordering

Before payment, you confirm the following declaration by ticking a mandatory box. An order is not possible without this confirmation:

“I expressly request that GREM begin performance before the end of the withdrawal period. I am aware that I lose my right of withdrawal upon complete performance of the contract.”

You then complete the order with the button “Order with obligation to pay”.

By making this declaration, you request that we begin performance before the end of the withdrawal period. As long as the services have not yet been provided in full, you may still withdraw within the withdrawal period. In that case, you owe us the reasonable amount described above for the services already provided up to your withdrawal.

Confirmation after payment

After successful payment, we send you a confirmation of the contract by e-mail, i.e. on a durable medium. You receive the confirmation before we begin performing the services. The confirmation contains:

the terms of the package or report audit ordered,
these withdrawal instructions together with the model withdrawal form,
the wording of your declaration when ordering, with the date and time at which you made it,
the invoice.

No right of withdrawal for traders

The statutory right of withdrawal is available to consumers only. Traders within the meaning of § 14 BGB, in particular real estate brokers, brokerage firms and other users who order services from GREM for their trade, business or self-employed professional activity, have no right of withdrawal.
